Misdiagnoses

In addition to failure to diagnose, medical malpractice can also occur with a misdiagnosis. If a physician fails to observe symptoms that are clear and this leads to a faulty diagnosis, the physician can be held liable if damage or death results. There are a myriad of circumstances where a medical provider can be held liable for misdiagnosis of a condition.

Of course, the misdiagnosis or failure to diagnose must also lead to injury causally related to the negligence.
